Know the SNC Terms & Conditions

These terms and conditions state important requirements regarding your use of computer repair and other services from Sarceno Network Consulting, LLC (SNC) and your relationship with SNC. It contains important information and instructions during and after computer repair and other services, such as service duration, fees, limitations of liability, privacy, and settlement of disputes related to computer repair, by arbitration instead of in court. If you accept this agreement, it will apply to all your service plans from us regarding computer repair, including all your existing plans with respect to PC repair and other services.

 

“Agreement”

These terms and conditions, together with each accepted plan order submitted by you related to computer repair and other services, any additional terms mentioned for your plan order for PC repair and the privacy policy, state the entire agreement between you and SNC (the “agreement”) with respect to all computer repair issues. The plan order for PC repair and other services will form the part of the “agreement” only if the same has been acknowledged by SNC in writing or by an e-mail. You must agree to the terms and conditions in order to be eligible to use the SNC portal (defined below), or obtain computer repair and other services (defined below). If you choose not to submit a plan order for PC repair, then the entire “agreement” between you and SNC consists of these terms and conditions for PC repair, any additional terms mentioned for your plan order for computer repair, and the privacy policy.

 

“SNC”

“SNC” is Sarceno Network Consulting, LLC dealing with PC repair and other services.

 

“You”

“You” means yourself, any person, including any employer that you are acting on behalf of, before opting for computer repair and other services.

 

“Contract Plans”

“Contract plans” are tenured subscription plans offered by SNC for computer repair, that are active for a specified period and will not include any incident based plans related to PC repair such as “per incident plan” or the like with respect to PC repair and other services.

 

“Project Plans”

“Project plans” are offered by SNC for specific projects with specific objective related to computer repair. The project plan contains objectives, task, timelines and other item related to the plan with computer repair in mind. These Terms and Conditions govern all project plans about PC repair, unless otherwise stated on the project plan. In the event of any conflict, these terms and conditions control any plan order form that you submit requesting services (“plan order”) for computer repair

 

“Services” and “SNC portal”

All references to “services” refer to any SNC contract plan related to PC repair, that you enter into with SNC through use of the SNC web portal located at www.snc-llc.com (the “SNC portal”) or by calling the SNC phone number mentioned on the web portal referring to PC repair. These terms and conditions govern all computer repair plans available through the SNC portal, and any use of the SNC portal for computer repair. In the event of any conflict these terms and conditions control any plan order form for PC repair that you submit requesting computer repair and other services (“plan order”).

 

“Materials”

“Materials” means any web casts for computer repair, download areas, white papers for computer repair, press releases, datasheets for computer repair, faqs, product information, quick reference guides, or other works of any kind related to computer repair and other services, that are made available to download from the SNC portal are the proprietary and copyrighted work of SNC and/or its suppliers with respect to PC repair. The definition of “materials” does not include the design or layout of the SNC.net web site or any other SNC owned, operated, licensed or controlled site in any computer repair issue.

 

“Software”

“Software” means a computer program of any kind, but mostly related to computer repair here, whether owned by SNC or a third party, whether delivered via download, cd, other media, or other delivery method, including client and/or network security software. Elements of the software, related to PC repair, are protected under copyright, trade secret, unfair competition, and other laws.

 

Submission of Plan Orders

You may order computer repair and other services by submitting plan orders for computer repair through the SNC email or by calling SNC. Once SNC accepts the plan order for PC repair submitted by you, then you will receive an email from SNC at the email address that you provide or have provided to SNC as part of the registration process for the computer repair services. SNC is not responsible for rendering computer repair and other services in connection with any plan order that it has not accepted. Upon acceptance by SNC of a plan order, you will have a service plan for PC repair.

 

Undertaking

Subject to the terms and conditions, and other terms specific to each contract plan for computer repair, SNC will address your query using commercially reasonable efforts in providing appropriate solutions under the PC repair and other services. In most cases, SNC will attempt problem diagnosis and a solution over the telephone, email or other means as it deems most appropriate under the circumstances including remote access (online support) to resolve computer repair and other issues. You understand that if remote access is used on your computer for PC repair, there will be no residual software from the remote session; however, there may be a non application files such as notes, shortcuts, text file, etc placed on your computer during and after computer repair. If such a file is placed on your computer during PC repair, you have the option to either save the file for future reference during computer repair or to delete it from your computer after PC repair. All undertakings under contract plans for computer repair are subject to SNC’s limited warranty, which is set forth below. Payment

Computer repair and other services against any plan order will be available once you have made payment for PC repair services according to the requirements of the corresponding plan order for computer repair. SNC has no obligation to render computer repair services under any service plan if the payments as required under any plan order for PC repair have not been made.

You understand that certain plans for PC repair may have onetime fee including, but not limited to “service fee” and/or “activation fee” for computer repair. This fee will not be refunded in case of cancellation of the plan related to computer repair, unless otherwise stated in the plan order for computer repair.

When you purchased the PC repair or any other service, you agreed to specific price and plan, which may have included a term of one, two or three years. Similarly, some computer repair plans may offer a discount on the service if you sign up for other SNC services. You agree to maintain your service and the bundled services related to PC repair for the applicable term. If you signed up for a term plan or a bundle discount for computer repair, the price available with those plans is valid until one of the following occurs:

  1. The term expires for computer repair;
  2. You drop one of the SNC services for computer repair you were required to purchase to receive the special rate
  3. You terminate the agreement/service related to PC repair before the expiry of the term.

 

Credit Card billing

All credit card payment for computer repair and other services will be processed by Paypal. An email invoice with a link to Paypal or a link on our web portal will be available for you to process the payment related to computer repair. You may be asked to provide us with a retainer fee to activate your PC repair service. You hereby authorize SNC to charge and/or place a hold on your credit card with respect to any unpaid charges for computer repair and other services or any related equipment.

You authorize the issuer of the credit card to pay any amounts described herein without requiring a signed receipt after computer repair, and you agree that these charges are to be accepted as authorization to the issuer of the credit card to pay any amounts described herein towards computer repair, without requiring a signed receipt, and you agree that these charges are to be accepted as authorization to the issuer of the credit card to pay all such amounts after PC repair.

You authorize SNC and/or any other company who bills products or computer repair services, or acts as billing agent for SNC to continue to attempt to charge and/or place holds with respect to all sums described herein directed towards PC repair, or any portion thereof, to your credit card until such amounts are paid in full.

You acknowledge and agree that neither SNC nor any SNC affiliated company will have any liability whatsoever for any non-sufficient funds or other charges incurred by you as a result of such attempts to charge, and/or place holds on, your credit card. If you mistakenly provide a debit card number, instead of a credit card number to pay the charges for PC repair, you authorize all charges described herein to be applied to such debit card unless and until you provide a credit card number after PC repair.

In the event you are enrolled for PC repair, or later enroll, in an automatic payment or electronic funds transfer plan with respect to computer repair, you agree that all sums described herein may be charged for computer repair, at SNC option, to the account number provided for such automatic payment or electronic funds transfer plan for computer repair. When payment is made by credit card or debit card towards computer repair, payment will also be subject to the terms and conditions established by the credit or debit card issuer for PC repair.

 

Renewal policy

Any plan for computer repair will NOT be renewed without explicit approval from you. If you would like to re-activate, please call us at (916) 222-3794 and speak with one of our customer service representative for computer repair at least 30 days prior to your subscription end date for PC repair and other services.

 

Early termination fee

When you purchased the computer repair or any other service, you agreed to a specific price and plan, which may have included a term for PC repair. You agree that if you cancel your plan for PC repair before the end of the term, you will pay the early termination fee associated with that plan for computer repair. If you did not sign up for a term plan for computer repair, the term for your PC repair and any other service will be month-to-month.

 

Privacy policy

The SNC privacy policy with respect to computer repair, which is an integral part of these terms and conditions for PC repair, is incorporated here by reference. If you have not yet reviewed the Privacy Policy for PC repair then please do so prior to agreeing to these terms and conditions for PC repair and other services.

 

No unlawful or prohibited use

As a condition of your use of the SNC portal or any services for computer repair, you will not use the materials, software or services for any purpose that is unlawful or prohibited by these terms and conditions for computer repair. You may not use the PC repair services, materials, or software in any manner that could damage, disable, overburden, or impair any SNC server, or the network(s) connected to any SNC server, or interfere with any other party’s use and enjoyment of any of the SNC portal, the materials, software or services related to PC repair. You may not attempt to gain unauthorized access to any SNC portal during and after computer repair, the materials, software or services, other accounts, computer systems or networks connected to any SNC server or to any of the SNC portal for computer repair, the materials, software or services, through hacking, password mining or any other means. You may not obtain or attempt to obtain any SNC portal during and after PC repair, the materials, software or services or information through any means other than that specifically permitted to you under a plan order for computer repair. SNC reserves the right at all times to disclose any information regarding computer repair as SNC deems necessary to satisfy any applicable law, regulation, legal process or governmental request, or to edit, refuse to post or to remove any information or materials, in whole or in part, in SNC’ s sole discretion, during and after PC repair and other services.

 

Indemnity

With respect to computer repair, you agree to indemnify, defend, and hold SNC, its subsidiaries, affiliates for PC repair, officers, directors, employees for PC repair, agents, licensors, consultants for PC repair, suppliers, and any third-party web site providers harmless during and after computer repair, from and against all claims for computer repair, demands, actions, liabilities, losses, expenses, damages, and costs, including actual attorneys’ fees for computer repair, resulting from your violation of these terms and conditions for PC repair, misuse or abuse of a PC repair service, or your infringement, or infringement by any other user of your account, of any intellectual property or other right of any person or entity involved in PC repair. You will cooperate as fully as reasonably required in SNC’s defense of any claim related to computer repair. SNC reserves the right, at its own expense, to assume the exclusive defense and control of any matter related to computer repair, otherwise subject to indemnification by you and you shall not in any event settle any matter without the written consent of SNC. You agree immediately to notify SNC of any unauthorized use of your account or any other breach of security known to you regarding PC repair.

 

Communications services

SNC may provide you during and after computer repair, with the use of e-mail services, addresses, bulletin board services related to computer repair, instant messaging services, chat areas related to PC repair, news groups, forums related to PC repair, communities, personal web pages, calendars, file cabinets and/or other message or communication facilities designed to enable you to communicate with SNC’s employees and others as appropriate to your service under a plan order (each a “communication service” and collectively “communication services”). Communications services shall only be used under an accepted plan order for computer repair, and not for any other purpose.

 

Limited licenses to use the SNC portal, materials and software

As permitted through a service related to computer repair, you may use materials and software posted on the SNC portal, or made available in connection with a plan order for PC repair, which may be available for additional purposes and or subject to additional restrictions.

 

General license restrictions

Any other use of the SNC portal, computer repair and other services, materials or software, other than as explicitly permitted by SNC is prohibited. Rights to execute, copy, modify, display, transmit, distribute, manufacture, use, sale during and after PC repair, are all reserved to SNC and its suppliers. Reverse engineering and de-compilation of the software is strictly prohibited during and after computer repair.

 

User responsibility

In connection with obtaining computer repair and other services, you agree that you will:

  • Cooperate with the SNC Consultant (technician): We will use commercially reasonable efforts to provide the support to you related to computer repair. Our experience shows that most issues for PC repair can be corrected as a result of close cooperation between you and the technician. Please listen carefully to the technician and follow the technician’s instructions during computer repair. You must confirm that the following conditions are true:
    • The situation giving rise to the question (computer repair or any other issue) is, reproducible on a single system, i.e., one central processing unit with its workstations and other peripherals;
    • You must have knowledge regarding the hardware system, any software involved, and in the facts and circumstances surrounding the incident leading to PC repair;
    • The full system, including software and hardware, is available to you and accessible by you during computer repair, without limit during any telephone discussions with SNC support personnel for PC repair.
  • Software/data backup: You understand and agree that SNC shall under no circumstance be responsible for any lost or corrupted software or data during and after computer repair. SNC strongly recommends that you at all times maintain a complete data backup and disaster recovery plan during PC repair.
  • Account, password, and security: For you to submit a plan order for PC repair, you must complete the registration process by providing us with current, complete and accurate information as prompted by and required under the applicable registration form for computer repair. Your account name for computer repair will be your email address. A password will be provided and will require you to change when you first log in before computer repair. You are solely and entirely responsible for maintaining the confidentiality of your password during PC repair. Furthermore, you are solely and entirely responsible for any and all activities for PC repair that occur under your account during computer repair. You agree to notify SNC immediately of any unauthorized use of your account or any other breach of security during and after PC repair. SNC will not be liable for any loss that you may incur as a result of someone else using your password or account for computer repair, either with or without your knowledge during computer repair. However, you could be held liable for losses incurred by SNC or another party related to PC repair due to someone else using your account or password when computer repair is in progress. You may not use anyone else’s account at any time during computer repair, without the permission of the account holder.

 

Availability of services and materials under force majuere circumstances

You hereby acknowledge with respect to computer repair that circumstances outside of SNC’s reasonable control (e.g., acts of god, a large scale outbreak of a new computer virus, strikes, riots, wars, other military action, civil disorder, acts of terrorism, fires, floods, vandalism, sabotage, acts of third parties, or the like) may cause significant delays in SNC’s ability to schedule a support session related to computer repair. You hereby release SNC from any and all liability related to PC repair, and agree that SNC shall not be liable to you or any third party for any direct or indirect damages whatsoever, resulting from such delays related to PC repair.

SNC or its suppliers may, at any time, without notice or liability, restrict the use of the computer repair or any other service or limit its time of availability in order to perform maintenance activities and to maintain session control during PC repair.

 

Exclusions from “services”

“Services” shall not include the following:

  • Any item or activity not covered by the terms of a plan order for computer repair;
  • Service beyond the duration limitations identified in your plan order for PC repair;
  • Problem diagnosis and support that may not be completed because of a problem with your computer or other equipment, or their configuration during computer repair that is beyond our control;
  • Software, including the operating system and software added to the registered hardware products which are out of scope for the service plan for computer repair;
  • Problems with PC repair that may and do result from:
    • External causes such as accident, abuse, misuse, or problems with electrical power during computer repair;
    • Usage that is not in accordance with product instructions provided by manufacture leading to computer repair;
    • Failure to follow the product instructions provided by manufacture or failure to perform preventive maintenance leading to PC repair; or
    • Problems caused by using accessories, parts, or components not compatible with the product leading to PC repair;
    • Non compliance with the SNC technician instructions for resolving the query during computer repair.

 

Notice specific to materials and software available on the SNC portal, or through a service

For your convenience, SNC may make available materials or software (as each term is defined above) for use and/or download, whether as a part of a computer repair or any other service, or in promotion of the PC repair services. Use of any materials and any software is governed by: The more stringent of (a) the terms of the end user license agreement (“eula”) for PC repair, if any, which accompanies the specific materials and software for computer repair, or (b) if there is no eula for PC repair, these terms and conditions during computer repair.

The materials and software are made available for download solely for use by you according to (a) the eula for PC repair, and (b) the plan order for computer repair. Any reproduction or redistribution of the PC repair service not in accordance with the eula is expressly prohibited by law, and may result in severe civil and criminal penalties. Violators will be prosecuted to the maximum extent possible. No logo, graphic, sound or image from any SNC web site during and after computer repair may be copied or retransmitted unless expressly permitted by SNC for PC repair.

Without limiting the foregoing for computer repair, copying or reproduction of the materials or software related to PC repair to any other server or location for further reproduction, redistribution or any other purpose is expressly prohibited, unless such reproduction or redistribution is expressly permitted by the eula for computer repair accompanying such material or software.
End user license agreements (eula)

In connection with our computer repair and any other service, we may provide to you, the use of certain software which is owned by SNC or its third party licensors, and suppliers for PC repair. We, as well as the third party licensors, reserve the right to update or change the software related to computer repair, from time to time and you agree to cooperate in performing such steps as may be necessary to install any updates or upgrades to the software for computer repair. You may use the software only as part of, or for use with, the PC repair service in accordance with the service plan and for no other purpose.

The software may be accompanied by a eula for computer repair from SNC or a third party. Your use of the software related to computer repair, is governed by the terms of that license agreement and by this agreement, where applicable. You may not install or use any software related to computer repair, that is accompanied by or includes a eula unless you first agree to the terms and conditions of the eula.

 

Third party software

As part of the computer repair and other services, SNC may suggest that you acquire, install and use certain third party software (“third party software”) for computer repair. Third party software for PC repair is licensed to you by the respective owners or licensees of the third party software for computer repair. You must agree to the terms and conditions set forth by such owners or licensees before installing third party software related to PC repair, whether SNC assists you in the acquisition, installation, and/or use of third party software. SNC has no rights to the third party software required for computer repair and does not license third party software to you or make any representation or warranty regarding the third party software for PC repair.

 

Third party agreements

As part of the computer repair services, SNC may suggest certain third party services to you. If you choose to subscribe to or otherwise use any third party services for PC repair, your use of any such services is subject to the terms of service of such third party service provider for computer repair. You agree to comply with such provider’s terms of service and that the third party provider is solely responsible for delivery of its service(s) to you and your use of them during computer repair. Third party services include, but are not limited to technical support, portal, training, music, gaming and storage services that SNC may elect to make available from time to time for providing computer repair. Violation of such third party provider’s terms of service may, in SNC’s sole discretion, result in the termination of your customer account and use of service for PC repair.

 

Limited service warranty

SNC disclaims all warranties express or implied as to the computer repair and other services, the materials and the software whether in the nature of merchantability or fitness for a particular purpose related to PC repair, or otherwise. In the event that you are not satisfied with the computer repair services, your sole remedy is to allow SNC to re-perform the PC repair services subject to dispute.

 

Limitation of liability

Notwithstanding anything to the contrary for PC repair, in no event shall SNC be liable to you in excess of the amounts actually paid by you to SNC under the plan order for computer repair, that is the subject of the dispute.

 

Limitations on actions

Any cause of action by you must be commenced within one (1) year after the cause of action arose after computer repair, or it shall be forever waived and barred.

 

Term and termination

SNC at its sole election may terminate or suspend your computer repair service immediately without notice if, in the sole discretion of SNC: (a) you are in breach of any of the terms and conditions (including but not limited to all policies regarding abuse and acceptable use of the PC repair service) or any license for third party software related to computer repair; (b) your use of the PC repair service is prohibited by law or is disruptive to, adversely impacts or causes a malfunction to the computer repair service, SNC’s network, or the use and enjoyment of SNC’s other users; (c) SNC receives an order from a court to terminate the computer repair service you are availing ; (d) if SNC for any reason ceases to offer the computer repair or any other service; (e) if you are no longer a SNC customer for computer repair, or (f) SNC determines that you are abusing the PC repair or any other service. SNC, in its sole discretion, may refuse to accept your request for the computer repair service, renewal or re-subscription following a termination or suspension of your use of the PC repair service.

 

Serviceability

If any provision of the terms of computer repair service be held invalid or unenforceable, that portion shall be enforced to the maximum extent possible, and all other provisions contained in the terms of service for computer repair shall remain in full force and effect. SNC’s failure to enforce any provision of the terms of service related to PC repair, shall not be deemed a waiver of such provision nor of the right to enforce such provision for computer repair.

 

No offer

SNC portal is available internationally for PC repair and may contain references to SNC products, computer repair and other services, and programs that are not available in a viewer’s country. These references do not imply that SNC intends to make such products, services, or programs related to PC repair, available in such country.

 

Modification

SNC reserves the right to amend the terms and conditions related to computer repair and other services, and the SNC portal at any time by (a) posting a revised version of the terms and conditions related to computer repair on the SNC portal http://www.snc-llc.com/Terms and Conditions, or by (b) sending information regarding any amendment to the terms of service for PC repair to the email address you provide to SNC in connection with registration for computer repair. You are responsible for regularly reviewing the SNC website during PC repair, to be notified of any amendments to the terms and conditions. Your use of the SNC portal, or the computer repair services after an amendment to the terms and conditions for PC repair shall be deemed acceptance by you of the amended terms and conditions.

 

Law

This agreement and the rights and obligations of the parties under this agreement related to computer repair, and any disputes arising out of or in connection with this agreement for PC repair shall be governed in all respects by the laws of the United States of America without regard to conflicts of laws principles for PC repair that would require the application of the laws of any other jurisdiction during and after computer repair.
